TERMS & CONDITIONS (TOUR AGREEMENT)

These Terms and Conditions (“Terms”) form the basis of my contract with Now Journey LLC (“Now Journey”). I should read them carefully before booking.

In this document, I am the Lead Traveler, and I represent all members of my party. I am responsible for any minors traveling with me. References to “I,” “me,” “my,” or “traveler(s)” refer to myself and all members of my party.

Now Journey LLC is a U.S. business registered in the State of Colorado with a principal address at 9457 South University Blvd, No. 530, Highlands Ranch, Colorado 80126.

“Suppliers” or “Service Providers” refers to all third parties providing services during my trip, including airlines, hotels, guides, transportation providers, and activity operators.

These Terms apply to all bookings made with or through Now Journey and supersede any prior communications, whether written or verbal. Together with my Proposal and Invoice, these Terms constitute my Tour Agreement.

PROPOSALS & AVAILABILITY

Proposals issued by Now Journey are valid for 48 hours and are subject to availability. Prices and availability are not guaranteed until a booking is confirmed and payment is received.

Some services are non-refundable once booked. These will be identified in my Proposal or Invoice. Trip Cancellation & Interruption Insurance is strongly recommended.

TRAVELER ELIGIBILITY

• On Now Journey branded small group tours, all travelers must be 11 years of age or older

• Travelers under 18 must be accompanied by an adult

• Private Journeys and Concierge Services have no age restrictions unless otherwise noted

PASSPORTS & VISAS

All travelers, regardless of age, must hold a valid passport that remains valid for at least six (6) months beyond the return date of travel.

Travelers are solely responsible for obtaining any required visas, entry permits, or documentation.

HEALTH, MOBILITY & SPECIAL NEEDS

I agree to disclose to Now Journey any medical condition, mobility limitation, disability, or special need that could affect my participation or that of a minor traveling with me.

If my condition or behavior adversely affects the tour or other travelers, Now Journey may remove me from activities or from the tour entirely, without refund of unused services, as determined by the trip or tour leader: the Now Journey Tour Captain, Lead Captain, Local Host, or designated representative.

If I or a minor in my care cannot keep pace with the group, I am responsible for arranging and paying for my own transportation.

TRAVELER REPRESENTATIONS

By booking, I represent that neither I nor any minor traveling with me has a condition that creates a hazard to myself or others. Now Journey reserves the right to refuse or remove any traveler whose participation may impact safety, operations, or the enjoyment of others.

Airlines and transportation providers are independent contractors and are not responsible for events occurring outside their conveyances. International air carriers are subject to international conventions limiting liability.

TRAVEL INSURANCE (STRONGLY RECOMMENDED)

Now Journey strongly recommends that I purchase Trip Cancellation & Interruption Insurance within 14 days of my initial deposit.

Insurance may include coverage for:

• Trip Cancellation & Interruption

• Medical & Emergency Evacuation

• Trip Delay & Baggage Delay

Insurance is not sold by Now Journey, and I am responsible for understanding my policy.

If I decline travel insurance, I understand that all payments become non-refundable within 100 days of departure, regardless of reason, including illness, injury, family emergency, work conflict, airline disruption, weather, or Force Majeure.

BOOKING & DIGITAL ACCEPTANCE

Bookings with Now Journey are completed through the WeTravel booking platform or other authorized digital systems.

To confirm my booking, I agree to:

1. Accept my Proposal electronically

2. Review and accept these Terms and Conditions

3. Submit payment via WeTravel, invoice, phone authorization, check, or wire transfer

4. Receive written confirmation from Now Journey

By checking the acceptance box, electronically signing, submitting payment, or completing a booking through WeTravel, I acknowledge that:

• I have read and agree to these Terms in full

• My electronic acceptance constitutes a legally binding signature

• This agreement is enforceable to the same extent as a handwritten signature

Now Journey retains electronic records of acceptance, which may be used as evidence of agreement.

PASSPORT SUBMISSION REQUIREMENT

A copy of the passport biodata page for all travelers must be submitted within seven (7) days of booking. No services will be arranged until passports are received. Any pricing increases due to delayed submission are my responsibility.

PAYMENT TERMS

(Effective for bookings on or after February 5, 2026)

FINAL BALANCE

Final payment is due 90 days prior to departure.

CANCELLATION, CHANGES & REFUNDS

(Uniform Policy – Applies Throughout This Agreement)

KEY DEFINITIONS

• 101+ days before departure: Deposit transferable

• 100 days or fewer before departure: Deposit non-transferable

All deadlines take effect at 12:01 AM local time.

NOW JOURNEY SMALL GROUP TOURS

Initial Deposit
A non-refundable deposit (typically $700 per person unless otherwise stated) is required at booking.

• Transferable if cancellation or change is requested 101 days or more before departure

• Transferable deposit may be applied to a future trip of equal or greater value within two (2) years

• Deposits are traveler-specific and not transferable to another person

100 Days or Fewer Before Departure

• Deposit becomes non-transferable

• All payments are non-refundable

• Changes require a new deposit at current pricing

Tours booked within 90 days require full payment and are non-refundable.

Deposits, Payments & Refunds

The initial journey deposit is non-refundable; however, it may be transferred to a future Now Journey departure for up to two years from the original trip date, provided cancellation occurs at least 101 days prior to departure.

Beginning 100 days prior to departure, the initial deposit becomes non-transferable.

The final payment is due 90 days prior to departure, at which time all payments become 100% non-refundable and non-transferable.

Certain services arranged on behalf of our guests — such as on-tour flights, ferries, train tickets, special event admissions, or unique experiences — may become non-refundable once confirmed with our partners. Any such items will be clearly identified in your Proposal or Invoice.

Some specialty services may require an earlier deposit to secure availability. Guests will always be notified in advance if this applies.

For reservations made within 100 days of departure, certain experiences or inclusions may no longer be available due to limited capacity. Bookings made during this period are accepted subject to availability, and Now Journey cannot issue refunds for unavailable inclusions.

For this reason, Trip Cancellation & Interruption Insurance is strongly recommended to protect your investment.

PRIVATE JOURNEYS & CONCIERGE SERVICES

A non-refundable planning fee (typically $500 per group) is required to begin planning and is applied to the trip cost if the journey proceeds.

Additional deposits may be required based on supplier terms.

Final payment is due 90 days prior to departure and is non-refundable.

CHANGE FEES

Change requests made within:

• 30 days (Branded Tours), or

• 90 days (Private Journeys / Concierge Services)

may incur a $50 per person change fee, plus any supplier penalties.

AIRFARE

Airfare booked through affiliated agencies is a separate contract. Airline change or cancellation penalties apply and are the traveler’s responsibility. On Tour Required Airfare is non-refundable and not able to be changed (trip cancellation and interruption insurance is recommended).

MINIMUM PARTICIPATION & TOUR CANCELLATION

Some tours require a minimum number of participants.

If minimum participation is not met 30 days prior to departure, Now Journey may:

• Offer a modified itinerary, or

• Cancel the tour and issue a refund or a future travel credit, excluding non-refundable deposits

Only tours designated as “Book with Confidence” qualify for this option.

FORCE MAJEURE

Now Journey is not liable for failure or delay caused by events beyond its control, including natural disasters, pandemics, government restrictions, civil unrest, labor actions, supplier failure, or similar events.

Refunds are not guaranteed in such cases. Now Journey may offer a future travel credit at its sole discretion.

LIMITATION OF LIABILITY & ASSUMPTION OF RISK

Now Journey acts solely as an arranger of travel services provided by independent contractors and is not responsible for their acts or omissions.

Travel involves inherent risks. I voluntarily assume all such risks and release Now Journey from liability to the fullest extent permitted by law.

ARBITRATION & CLASS ACTION WAIVER

Any dispute shall be resolved exclusively by binding arbitration in Denver, Colorado, under the Commercial Arbitration Rules of the American Arbitration Association.

• Arbitration is the sole forum for dispute resolution

• Claims must be brought individually only (no class actions)

• Claims must be filed within one (1) year of trip completion

• Punitive, consequential, and special damages are waived

This Agreement is governed by the laws of the State of Colorado.

CONDUCT & PARTICIPATION

I agree to follow all laws, instructions, and guidelines provided by the Now Journey Tour Captain.

Now Journey may remove any traveler whose behavior disrupts the tour. No refunds or assistance will be provided for early termination due to conduct.

Unused services are not refundable.

PHOTOGRAPHY & MEDIA RELEASE

I grant Now Journey permission to use my likeness in photographs or video taken during travel for promotional purposes. Such use is royalty-free, worldwide, and perpetual. I may opt out by notifying Now Journey in writing prior to departure.

ENTIRE AGREEMENT & CONTACT

These Terms, together with my Proposal and Invoice, constitute the entire agreement between the parties.
