Now Journey LLC Terms and Conditions

Terms Version: August 12, 2026

These Terms and Conditions (the “Terms”) form part of the contract between each traveler and Now Journey LLC (“Now Journey”). Please read them carefully before booking.

These Terms, together with the traveler’s accepted Proposal, Invoice, booking confirmation, and any written or electronic amendments, constitute the Tour Agreement. The version of the Terms accepted in connection with a traveler’s booking governs that reservation unless the parties subsequently agree to an amendment.

Now Journey LLC is a U.S. business registered in Colorado with a principal address at 9457 South University Blvd., No. 530, Highlands Ranch, Colorado 80126.

Proposals, Availability & Order of Precedence

Unless a different period is stated, a Proposal issued by Now Journey is valid for 48 hours and remains subject to availability. Pricing and availability are not guaranteed until the booking requirements identified in the Proposal or Invoice are completed and Now Journey issues confirmation.

If a trip-specific provision in an accepted Proposal or Invoice expressly conflicts with these general Terms, the expressly identified trip-specific provision controls for that particular Journey. A supplier-specific non-refundable amount or earlier payment date supersedes the standard schedule only when it is clearly disclosed before the traveler accepts or pays for that service.

These Terms do not supersede a trip-specific term previously accepted for an existing reservation merely because the website is later updated.

Traveler Eligibility & Individual Acceptance

The person administering a reservation is the Lead Traveler. The Lead Traveler coordinates booking communications and payments and agrees to provide each party member with accurate, timely information. The Lead Traveler does not, merely by serving in that role, waive substantial legal rights on behalf of an unrelated adult without legally sufficient authority.

Each adult traveler is bound through that traveler’s electronic acceptance, signature, payment, participation in the booking or Journey with notice of the Terms, or another legally sufficient method of acceptance. A parent or legal guardian must accept for a minor.

  • Travelers on Now Journey branded small-group tours must be 11 years of age or older unless the accepted Proposal states otherwise.
  • A traveler under 18 must be accompanied by a responsible adult.
  • Private Journeys and Concierge Services have no general age restriction unless the applicable Proposal, supplier, or activity states one.

Passports, Documents & Traveler Information

Each traveler is responsible for providing correct legal names, dates of birth, passport information, and other details required to arrange services. If incorrect or late information causes a supplier correction, reissue, price increase, or penalty, the traveler is responsible for that reasonable documented cost.

Each traveler is responsible for obtaining and carrying passports, visas, entry permits, health documents, parental consents, and other documentation required for the itinerary, and for complying with destination rules. Many destinations require passports to remain valid for an extended period after travel. Requirements vary, and travelers must satisfy the requirements applicable to their itinerary.

Now Journey may require a readable copy of each traveler’s passport biodata page within seven (7) days after booking, or by another disclosed deadline, so that reservations can be made accurately. Now Journey may delay booking affected services until the required information is received.

Health, Mobility & Accessibility

Travelers should inform Now Journey as early as reasonably possible of accommodation requests or functional limitations that may affect participation so available reasonable accommodations can be discussed. Relevant considerations may include walking distance, stairs, uneven terrain, transfers, boarding vehicles or vessels, altitude, climate, and the pace or remoteness of an itinerary.

Now Journey will consider an individual traveler’s circumstances and available reasonable accommodations. A disability or medical condition alone is not a basis for exclusion. Now Journey may determine that a traveler cannot safely participate in a particular activity when, based on actual circumstances, a legitimate safety or operational issue cannot be adequately addressed through a reasonable accommodation.

Now Journey does not control and cannot guarantee the accessibility of third-party hotels, historic sites, vessels, vehicles, restaurants, or infrastructure, particularly in foreign or remote destinations. Travelers must be able to follow reasonable safety instructions. A traveler who cannot keep pace with the group may need to arrange and pay for alternative transportation or assistance.

Travel Insurance

Now Journey strongly recommends that travelers purchase comprehensive Trip Cancellation & Interruption Insurance, preferably shortly after making their initial deposit. Depending on the policy, coverage may include:

  • Trip Cancellation & Interruption
  • Medical Expenses
  • Emergency Evacuation or Repatriation
  • Trip Delay
  • Baggage Delay or Loss

Travel insurance is separate from Now Journey’s cancellation and refund policies. Purchasing insurance does not make payments to Now Journey refundable, and declining insurance does not create or accelerate a cancellation penalty.

Depending on the coverage purchased and circumstances involved, an insurer may reimburse a traveler for a covered loss. Coverage decisions are made exclusively by the insurer. Now Journey does not sell or underwrite insurance, determine coverage, or guarantee benefits. Whether or not insurance is purchased, the cancellation, payment, transferability, and refund provisions of the traveler’s Tour Agreement remain applicable.

Booking, Digital Acceptance & Records

Bookings may be completed through WeTravel or another authorized system. By checking an acceptance box, electronically signing, submitting payment with notice of the applicable terms, or otherwise completing a legally sufficient acceptance step, the traveler intends to enter a binding agreement enforceable to the same extent as a handwritten signature.

Where technically available, Now Journey may retain records identifying the traveler, date and time of acceptance, Terms version and effective date, related booking or transaction, accepted Proposal or Invoice, and electronic acceptance record. Electronic copies and signatures may be treated as originals to the extent permitted by law.

Future changes to website Terms do not silently rewrite the contract governing an already-confirmed booking. A material amendment to an existing reservation is effective only when the parties agree through a legally sufficient written or electronic process.

Payment, Cancellation, Changes & Refunds

Effective August 12, 2026, the standard final payment deadline for all new Now Journey bookings is ninety (90) days prior to departure, unless an earlier payment deadline is expressly identified in the traveler’s Proposal or Invoice due to supplier requirements.

Bookings confirmed before August 12, 2026 remain governed by the payment schedule and cancellation terms disclosed and accepted at the time of booking. Nothing in these revised Terms accelerates the final-payment deadline or otherwise materially changes the payment obligations of an existing reservation unless the traveler subsequently agrees in writing or electronically to revised terms.

The following standard schedule applies to new Now Journey Small Group Tours, Private Journeys, Concierge Journeys, custom or private group travel, and other Now Journey-operated Journeys confirmed beginning August 12, 2026, except where an accepted Proposal or Invoice clearly states a different trip-specific or earlier supplier deadline.

101 Days or More Before Departure

  • The initial deposit remains non-refundable.
  • When permitted by the applicable booking terms, the initial deposit may be transferred to another eligible Now Journey departure of equal or greater value.
  • A transferred deposit must be used within two years of the original scheduled departure.
  • The deposit remains traveler-specific and cannot be transferred to another person.
  • Separately disclosed supplier-specific non-refundable amounts remain non-refundable.
  • Any other prepaid amount is handled according to the accepted Proposal or Invoice and applicable law.

100 Days to 91 Days Before Departure

  • The initial deposit becomes non-transferable.
  • Amounts already paid or contractually committed to non-refundable suppliers remain non-refundable.
  • The standard final balance has not yet reached its due date, unless an earlier supplier deadline was expressly disclosed in the accepted Proposal or Invoice.
  • An unpaid standard final balance does not become due solely because the traveler cancels during this interval, except for amounts otherwise owed under the accepted Tour Agreement or committed to suppliers.

90 Days or Fewer Before Departure

  • The final balance is due.
  • One hundred percent (100%) of the Journey Price becomes due and non-refundable, subject to applicable law and any express terms of the accepted Proposal or Invoice.
  • No refund is due for voluntary cancellation, late arrival, early departure, no-show, or unused services except where required by law or expressly stated otherwise in the Tour Agreement.

Bookings Made Within 90 Days

  • Full payment is required at booking.
  • Payment is non-refundable and non-transferable except as required by applicable law or expressly stated in the accepted Proposal or Invoice.

Earlier Supplier Deadlines

Some safari camps, villas, charter transportation, internal airfare, ferries, rail, special events, unique experiences, cruises, exclusive-use properties, high-demand hotels, or other supplier services require earlier or separately non-refundable commitments. An exception applies only when it is clearly identified in the accepted Proposal or Invoice before the traveler accepts or pays for the affected service.

Cancellation Notice & Timing

A traveler cancellation must be delivered in writing to go@nowjourney.com. Cancellation is effective when received by Now Journey. Deadline calculations use the Journey’s scheduled departure date and take effect at 12:01 a.m. in the departure location’s local time unless the accepted Proposal or Invoice states otherwise.

Change Fees

A traveler-requested change made within 30 days of a branded tour, or within 90 days of a Private Journey or Concierge Service, may incur a $50 per-person administrative change fee plus reasonable supplier penalties or fare differences. A fee is not punitive and will not be charged where prohibited by applicable law.

Transfers & Rebookings

A room change, permitted traveler-name correction, optional-experience addition, installment payment, or other minor reservation change does not by itself replace the payment and cancellation terms governing an existing booking.

For example, if a booking confirmed before August 12, 2026 required final payment 60 days before departure, that accepted 60-day deadline remains in force. If the accepted booking required final payment 90 days before departure, that accepted 90-day deadline remains in force.

For a material transfer or rebooking to a different Journey after August 12, 2026, the new 90-day policy applies only when a revised Proposal, Invoice, or booking amendment clearly states the new payment terms and the traveler affirmatively accepts them in writing or electronically. Any transfer remains subject to availability, eligible-departure requirements, supplier restrictions, and the accepted Tour Agreement.

Private Journeys, Concierge Services & Custom Groups

A non-refundable planning fee, typically $500 per group unless otherwise stated, may be required to begin customized planning. If the Journey proceeds, the accepted Proposal or Invoice will state whether and how that fee is applied to the Journey Price.

Additional deposits or earlier payments may be required based on supplier terms, but they control only when clearly disclosed before acceptance or payment. For new bookings beginning August 12, 2026, the standard final balance is otherwise due 90 days before departure.

Itinerary Changes & Substitutions

Travel requires reasonable operational flexibility. Now Journey may reasonably modify itineraries, hotels, restaurants, guides, Tour Captains, transportation, sightseeing order, departure times, activities, and other components because of weather, strikes, closures, supplier availability, transportation changes, local conditions, safety concerns, government action, operational requirements, or events beyond reasonable control.

Where feasible, Now Journey will seek reasonably comparable substitute services. A reasonable itinerary modification does not automatically constitute cancellation of the Journey. A specific hotel, guide, Tour Captain, restaurant, room, activity, or sequence is guaranteed only when the accepted Proposal expressly identifies it as guaranteed.

Hotels & Rooming

Unless expressly guaranteed in an accepted Proposal or Invoice, a specific room, bedding configuration, view, adjoining or connecting room, early check-in, or late checkout remains subject to hotel availability. Hotel substitutions may occur, and star classifications and room standards vary between countries and rating systems.

If Now Journey expressly sells a specific upgraded room or category and it becomes unavailable, Now Journey will provide a reasonable substitute, appropriate adjustment, or another remedy required by the Tour Agreement or applicable law.

Airfare & Transportation

Airfare purchased through an affiliated agency or directly from an airline may constitute a separate contract governed by the carrier’s rules. Airline schedule changes, fare differences, change fees, cancellation penalties, and documentation requirements are the traveler’s responsibility except to the extent the Tour Agreement or applicable law provides otherwise.

Airfare, rail, ferries, charter transportation, or other transportation sold or arranged as part of the Journey may be non-refundable or subject to earlier payment deadlines when clearly disclosed in the accepted Proposal or Invoice.

Optional Activities

An activity included in the accepted Proposal or sold, arranged, or paid through Now Journey forms part of the Tour Agreement subject to its disclosed terms.

An independent optional activity purchased directly by a traveler from an outside provider, without being sold or arranged by Now Journey, is a separate transaction between the traveler and that provider. Now Journey is not responsible for an activity it does not sell or arrange, except where applicable law provides otherwise.

No-Shows, Missed Services & Early Departure

Except as required by applicable law or expressly stated in the Tour Agreement, no refund or credit is provided for services voluntarily unused because of late arrival, missed transportation, no-show, early departure, voluntarily skipping an included activity, failure to possess required travel documents, or removal for material misconduct.

If a traveler causes themselves to become separated from the Journey, the traveler is responsible for reasonable costs of catching up with the group, including transportation, lodging, meals, and communication expenses.

Baggage & Personal Property

Travelers remain responsible for their baggage, valuables, and personal property. Baggage restrictions vary by destination and provider; safari flights, internal flights, vessels, and small vehicles may impose strict weight, size, or soft-bag requirements. Travelers are responsible for complying with requirements disclosed for their Journey.

Now Journey is not an insurer of lost, stolen, delayed, or damaged property. Nothing in these Terms excludes responsibility that applicable law does not permit Now Journey to exclude.

Medical Emergencies

When reasonably necessary and a traveler cannot practically make arrangements, a Now Journey representative may assist in obtaining emergency medical care, evacuation, transportation, or related services. Unless specifically represented otherwise, Now Journey personnel are not medical professionals and do not provide medical advice.

The traveler remains financially responsible for medical care, evacuation, repatriation, additional lodging, transportation, and related expenses, except to the extent caused by a matter for which Now Journey is legally responsible.

Minimum Participation & Now Journey Cancellation

Some Journeys require a minimum number of participants. If minimum participation is not achieved, Now Journey may offer another departure, an alternative Journey, a modified itinerary, or a voluntary future travel credit.

If Now Journey elects not to operate a Journey because minimum participation has not been achieved, the traveler will receive the remedy required by applicable law and the accepted Tour Agreement. A traveler is not required to accept a future travel credit when applicable law requires a refund.

This section addresses cancellation initiated by Now Journey. Traveler-initiated cancellations remain governed by the Payment, Cancellation, Changes & Refunds section.

Force Majeure & External Disruption

A Force Majeure event is an extraordinary event outside Now Journey’s reasonable control, potentially including severe weather, natural disaster, fire, flood, earthquake, volcanic activity, epidemic or pandemic, governmental restriction, war, terrorism, civil disturbance, strike or labor disruption, transportation shutdown, border closure, or supplier insolvency or operational failure beyond Now Journey’s reasonable control.

In response, Now Journey may reasonably postpone, reroute, substitute, modify, suspend, shorten, reschedule, or cancel affected services. Available remedies will be determined based on applicable law, amounts actually recoverable from suppliers, services actually provided, and the accepted Proposal or Invoice. Now Journey may offer a voluntary travel credit or alternative arrangement, but these Terms do not eliminate a refund or other remedy that applicable law requires.

Independent Suppliers

Now Journey arranges travel services supplied by independent hotels, airlines, guides, restaurants, transportation companies, ferries, rail operators, activity providers, and other suppliers. These suppliers control their day-to-day operations and may impose their own lawful terms.

To the extent permitted by law, Now Journey is not responsible for an independent supplier’s acts, omissions, insolvency, or operational decisions that Now Journey does not control. This provision does not exclude liability or remedies that applicable law does not permit Now Journey to waive.

Assumption of Travel Risk

Domestic and international travel involves ordinary and inherent risks. Depending on the Journey, these may include uneven surfaces, stairs, transportation and traffic, remote locations, illness, food or water differences, weather, altitude, wildlife, water activities, crime or theft, delay, limited medical resources, local infrastructure, and political or civil disruption.

Each traveler voluntarily accepts the ordinary and inherent risks reasonably associated with the Journey and is responsible for exercising reasonable care and following safety instructions. Nothing in these Terms releases Now Journey from liability that applicable law prohibits it from excluding.

Limitation of Liability

To the extent permitted by applicable law, Now Journey is not liable for indirect, incidental, consequential, special, or similar damages arising from a Journey or Tour Agreement.

This limitation does not apply to willful misconduct, fraud, or any liability, remedy, or category of damages that applicable law prohibits Now Journey from limiting or excluding. No monetary damages cap is created by these Terms.

Conduct, Safety & Removal

Travelers must comply with applicable laws and reasonable safety and operational instructions. Now Journey may remove a traveler from an activity or terminate participation for material conduct such as threats or violence, harassment, abusive behavior, illegal activity, dangerous intoxication, repeated disregard of reasonable safety instructions, or conduct materially interfering with Journey operations or the safety or reasonable enjoyment of others.

Removal will be based on the actual circumstances and is not justified by a minor personality disagreement alone. When termination results from the traveler’s material misconduct, unused services are not refundable, Now Journey is not responsible for onward travel arrangements, and reasonable documented costs caused by the removal are the traveler’s responsibility, except where applicable law requires otherwise.

Traveler-Caused Damage & Expenses

A traveler is responsible for reasonable documented costs arising from damage the traveler causes, fines caused by the traveler’s conduct, supplier penalties attributable to the traveler, replacement of damaged property, extraordinary cleaning or damage charges, and unauthorized hotel or vehicle charges passed to Now Journey.

Now Journey will not impose arbitrary punitive fees. This section does not limit any defense or protection available under applicable law.

Photography & Media

Now Journey may use ordinary photographs or video taken during a Journey for legitimate promotional purposes, subject to applicable privacy and publicity laws.

Opt out: A traveler who does not want their identifiable likeness used should notify Now Journey in writing at go@nowjourney.com before departure. Now Journey will use reasonable efforts to honor a timely opt-out.

Claim Notice, Dispute Resolution & Arbitration

Written Notice and Informal Resolution

Before commencing arbitration or litigation, a traveler must provide written notice to go@nowjourney.com describing the traveler, booking, facts, and requested resolution. The parties will then have 30 days to attempt a good-faith informal resolution, unless urgency or applicable law requires otherwise.

Small Claims or Individual Arbitration

Either party may bring an eligible individual claim in Small Claims Court where legally permitted. Otherwise, a dispute will be resolved by individual binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. The Federal Arbitration Act governs arbitration procedure where applicable.

The arbitrator may award any individual remedy available under applicable law. Hearing location, fees, and procedures will be determined under the AAA Consumer Arbitration Rules, applicable law, and the AAA Consumer Due Process Protocol.

Individual Proceedings and Jury Waiver

To the extent enforceable, claims must be brought individually and not as a class, collective, consolidated, or representative proceeding. For a claim required to be arbitrated, each party waives a jury trial to the extent permitted by law. This provision does not deprive a traveler of a non-waivable remedy.

Governing Law and Severability

Colorado law governs the Tour Agreement, subject to the Federal Arbitration Act and any non-waivable federal, state, or consumer protection law applicable to the traveler. If a dispute provision is unenforceable, it will be severed to the extent legally possible while the remainder continues. If the class-action waiver is unenforceable for a particular claim, that claim will proceed in court unless the parties agree otherwise.

A claim must be brought within the time allowed by applicable law. These Terms do not create a shorter contractual filing deadline.

General Provisions & Contact

Entire Agreement and Amendments

These Terms, the accepted Proposal, Invoice, booking confirmation, and written or electronic amendments constitute the entire Tour Agreement. Existing confirmed bookings cannot be materially modified merely by changing website Terms.

Severability, No Waiver and Headings

If a provision is unenforceable, the remaining provisions continue to the extent legally possible. A failure to enforce a right once does not automatically waive later enforcement. Headings are for convenience and do not alter meaning.

Version Control, Electronic Records and Survival

The accepted Terms version governs the reservation unless the parties agree to an amendment. Electronic copies and signatures may constitute originals to the extent permitted by law. Provisions intended by their nature to survive completion or cancellation—including payment obligations, dispute resolution, liability provisions, and media rights—survive where appropriate.
