The following Terms and Conditions form the basis of my contract with NowJourney LLC and I should therefore read them carefully. In this document, I, am the Lead Traveler, and I represent all members of my party and I am responsible for any minors in my charge, and I am referred to as “I,” “my,” “the traveler(s),” and/or “traveler(s),” and any reference to Now Journey (or its subsidiaries) means and/or refers to NowJourney LLC.
Now Journey and its subsidiaries are trade names of NowJourney LLC, a U.S. business registered in the State of Colorado, at 9457 South University Blvd, No 530, Littleton, CO 80126.
Reference to SUPPLIERS and SERVICE PROVIDERS means all third parties who provide services to me during my travel with Now Journey including airlines unless otherwise specified.
The following Terms and Conditions apply to all bookings with or through Now Journey. These terms and conditions supersede any others expressed in any other Now Journey commentary whether written or spoken.
Proposals from Now Journey are valid for 48 hours, but are based on availability. Prices and availability are subject to change until a trip is booked. Some items are non-refundable once a trip has been booked — the proposal/invoice and these Terms & Conditions together comprise my Tour Agreement. We highly recommend some form of Trip Cancellation & Interruption protection which will be discussed below.
On Now Journey’s branded trous, all travelers must be over the age of 11, and all travelers under 18 must be accompanied by an adult. Private Journeys do not have an age restriction. Certain departure are family friendly.
VALID PASSPORTS & VISAS
All travelers of any age must have a valid passport prior to booking, and the passport needs to be valid for at least six (6) months past the return date of my itinerary. All travelers are responsible for travel Visa requirements in the destination countries in which they are planning to travel.
DECLARATION OF MOBILITY AND HEALTH
I agree to provide Now Journey with any mobility or health issues related to me personally or to a minor who is traveling with me that may impede my/our ability to successfully participate in the tour. I understand that I may be removed from any activities or from the Now Journey group tour entirely without compensation should my mobility or health adversely affect the group tour as determined by the Journey Adventure Leader. If I or my minor child/ren (if applicable) cannot walk and keep up with the group, I will be responsible for getting myself and my minor child/ren (if applicable) to and from tour activities at my own expense.
These terms and conditions will apply to the lead traveler and members of their party once the Trip Agreement is completed and signed. The lead traveler will be referred to as "I," in this document. I, as the lead traveler (of me and my party) represent that neither I or anyone traveling with me as a minor has any physical or other condition or disability that could create a hazard to me or the minor. Now Journey reserves the right to decline to accept anyone on a trip. Now Journey reserves the right to remove from the trip, at his or her sole expense, anyone whose condition is such that he or she could create a hazard to himself or others, or otherwise impact the enjoyment of other passengers on the trip. Airlines used are not to be held responsible for any act, omission or event during the time passengers are not on board their planes or conveyances. International air carriers are subject to international air conventions limiting their liability. The limitations of liability are contained on the reverse side of the airline ticket and form part of the terms and conditions of this package. The passage contract in use by these companies, when issued, shall constitute the sole contract between the companies and the purchaser of these travel programs and/or passage.
TRAVEL INSURANCE: WE RECOMMEND YOU PROTECT YOUR VACATION COST AND TRIP EXPERIENCE WITH TRAVELER INSURANCE!
NowJourney recommends some type of travel cancellation and interruption insurance coverage: I understand that Now Journey recommends that I purchase travel cancellation and interruption protection within 14 days of my initial deposit to help protect me and my travel arrangements against the unexpected. Protection plans can include coverage for Trip Cancellation, Trip Interruption, Emergency Medical and Emergency Evacuation/Repatriation, Trip Delay, Baggage Delay and more.
As insurance products are not purchased through Now Journey, I am responsible for making myself aware of the benefits and limitations of any policy that I purchase.
If Travel Protection is Declined: I understand by not choosing travel protection that once I am within 30 days for trips booked by February 22, 2022, and within 60 days based on trips booked March 1, 2022 and beyond, there is no refund for any reason or circumstance.
I agree to comply by the following procedure(s):
1. Review and accept the Proposal document by reply email to Now Journey or by clicking “Accept” on my proposal (if function is available).
2. Review, initial and sign Terms and Conditions document contained in the Trip Agreement. All travelers 18 years of age and older must complete a separate Trip Agreement form. The Trip Agreement is the contract that goes into effect when the Confirmation Invoice is issued by, or on behalf of, Now Journey.
3. Make my deposit/payment online via my Now Journey Invoice OR call Now Journey at 1 888 412 4322 to provide my credit card details over the phone. Payments may also be accepted by hard copy check or bank wire transfer.
4. Receive a confirmation from Now Journey.
Occasionally, Now Journey is unable to confirm certain arrangements immediately (e.g. where preferred accommodation or service is available at the time of the traveler proposal, but after payment is received the accommodation or service is no longer available). Details on booked services and hotels will be provided in my final trip documents. If any service, excursion or property that has been specifically ordered cannot be obtained, Now Journey will notify me prior to departure with a similar alternative(s). Certain services are non-refundable and these will be disclosed to me in my proposal or shortly after the time it’s requested.
Reservations Requiring Passport for Pricing
As stated above, some tours require On-Tour Flights and pricing for these flights cannot be locked in until a passport is received. Prices may change until ticketed by Now Journey and any price differences due to the delay of receiving a Passport are the responsibility of the traveler(s).
I am responsible for checking all details of the Confirmation Invoice and all other documentation (including airline tickets, if applicable) immediately upon receipt. I will inform Now Journey immediately if anything appears to be incorrect as it may not be possible to make changes at a later stage. Now Journey regrets that it cannot accept any liability if Now Journey is not notified by me of any inaccuracies in any documentation within TWENTY-FOUR (24) hours of the issuance from Now Journey.
EXCLUSIONS FROM TOUR PRICE PROPOSAL
The Now Journey tour or trip prices provided in the proposals are, generally, for land only and do not include international flights to and from the beginning and ending locations (tour commencement and conclusion locations) unless otherwise specified. Some tours require On-Tour Flights, and these flights are priced separately from land tours on most departures (unless otherwise noted) and they are non-refundable.
PROVIDING VALID PASSPORT(s) ON TIME
Passport Biodata Page: A copy of my, and any minors in my charge, valid Passport(s) showing the biodata page (the page with my biographical data including name, date of birth, passport number, expiration date, and photo) is required within SEVEN (7) days of Now Journey receiving my booking and acceptance of Terms & Conditions via the completed and signed Trip Agreement. No services will be arranged for my booking until Now Journey is in receipt of my valid passport.
PAYMENTS, CHANGES and REFUNDS: Cancellations must be received in writing. Additional terms and fees will apply to Internal Air, any extra services and room cancellations.
INITIAL DEPOSITS, PAYMENTS & BALANCE DUE for Now Journey’s branded Small Social Group Tours:
Initial Deposit: A non-refundable of $100 per person deposit is required for any trip booked by August 28, 2021. Trips booked after August 28, 2021 require a non-refundable deposit of $100 to $500 per person depending on what is presented in your trip proposal. You acknowledge that the deposit is to be paid immediately at the time of your booking to secure your position on the trip. The initial deposit is non-refundable but it can be transferred to any other departure date or trip in the future providing you request the transfer per these rules: Cancellations outside of 30 days of departure for trips booked by February 28, 2022 will receive a full refund less the transferable deposit and any unrecoverable costs. Cancellations outside of 60 days of departure for trips booked from March 1, 2022 onward will receive a full refund less transferable deposit and any unrecoverable costs. There may be a 2nd required non-refundable deposit at around 120 days prior to the departure date to cover any non-refundable admission tickets, lodging pre-payments, or services. Once your deposit refund date has passed, your deposit will not be refunded under any circumstance.
Should the trip be cancelled by the traveler, the deposit can be applied towards a future trip up to 2 years from date of original departure. Should the trip be cancelled by Now Journey, the deposit will be converted to a future trip credit to be used within 2 years from date of original departure.
Additional deposits may be required in regards to rooms, admissions or activities that require pre-payment and are non-refundable. Trip cancellation and interruption insurance is highly recommended.
Final Balance: Final balance is due 30 days prior to departure for trips booked by February 28, 2022, and for trips booked March 1, 2022 and beyond, final balance is due 60 days prior to departure. You can easily change your tour date or destination up until your Final Payment Date. Payment is not refundable within 30 days of departure for trips booked by February 28, 2022, and 60 days for trips booked March 1, 2022 and beyond. Deposits for services requiring pre-payment for hotel rooms, excursions, on-tour flights, trains and other items are non-refundable: Trip cancellation and interruption insurance is highly recommended.
Tours commencing within 30 days for trips booked by February 28, 2022, and within 60 days for trips booked on March 1, 2022 and beyond: Payment is due in full and is non-refundable.
INITIAL DEPOSITS, PAYMENTS & BALANCE DUE for Now Journey’s Private Journeys and/or Concierge services:
Initial Deposit: Now Journey will provide you with a simple "highlights" version of the proposed itinerary and if approved, a non-refundable trip planning fee of $500 per group (not per person) will be required. When the proposed itinerary is accepted, a detailed version of the itinerary will be provided and the trip planning fee will be applied to the cost of the trip. Should the trip be cancelled before 60 days prior to trip departure by the traveler, the trip planning fee will be forfeited by the traveler.
Often for Personalized Journeys, earlier additional deposit amounts are required – the schedule will be based on a per trip project basis.
Final Balance: Final balance is due 90 days prior to departure. Payment is not refundable within 90 days of departure. Some excursions, on-tour flights, trains and other items are non-refundable regardless of booking date and will be noted on my invoice.
CHANGES/AMENDMENTS BY THE TRAVELER(S)
Should I wish to make any changes to my booking after it has been confirmed (e.g., changes to departure or return dates, destination, hotels, etc.), I must advise Now Journey in writing by email or hardcopy, and I must confirm Now Journey is in receipt of this notification.
Change requests to my reservation within 30 days (Branded Small Social Group Tours) and 90 days (Private Journeys or Concierge services) of my departure date will result in a $50 change fee per person, per request. While we will endeavor to assist, we cannot guarantee we will be able to meet such requests.
AIRFARES ARRANGED BY AFFILIATED COMPANY/IES
Any air arrangement made by any affiliated company air service is a completely separate booking from the traveler(s) Now Journey vacation.
Any questions concerning booked traveler airfare should be directed to the booking agency (online agencies, travel agencies, etc.). When changes can be made: If flight changes are requested after the deposit has been received, or if flights are cancelled by the traveler(s) after tickets are issued, revision fees or airline cancellation charges will apply.
TOURS PREVENTED FROM OPERATING
I understand that Now Journey may be prevented from operating a tour under one of two scenarios:
BOOK WITH CONFIDENCE: MINIMUM NUMBER OF TRAVELERS
Some tours may fall under our Book with Confidence program which states that if a tour does not have the minimum number of travelers required to operate at 30 days prior to the departure, Now Journey may choose to cancel the tour. Under this scenario travelers will be given the option to continue with the itinerary on a modified basis with all services as purchased including transfers, luggage movement, admissions and itinerary the same as per our website. Additional costs may arise and will be provided to booked travelers for review and approval. Alternatively, at the 30 day mark, travelers may choose to cancel their tour and receive a refund less the non-refundable deposit which would be converted to future trip credit. Note, only tours with the Book with Confidence program included can provide the refund at 30 days prior to the tour. All other tours follow the cancellation policy as stated above.
CIRCUMSTANCES BEYOND THE CONTROL OF NOW JOURNEY
The second scenario in which Now Journey may be prevented from operating a tour is due to Force Majeure. Now Journey regrets it cannot accept any liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented by reasons or circumstances amounting to ‘force majeure.’ Force majeure means any event which Now Journey or the supplier of the service(s) in question could not, even with all due diligence, foresee or avoid. Now Journey assumes no liability for any loss, damage, or entry of any nature in whole or in part resulting from an Act of God or any other Force Majeure condition, including, without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms, cyclones or hurricanes, civil unrest, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests or police action, strikes or labor disruptions, restrictions or restraint of rulers, peoples or governments, governmental or other expropriations, acts of terrorism, war insurrections, quarantine restrictions, epidemics, pandemics, government health advisories, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Now Journey that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the event that any of these conditions apply, Now Journey shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, without liability of any kind. We highly recommend some form of Trip Cancellation Insurance that will protect your vacation costs.
REFUNDS ON LAND VACATIONS
Approved refunds may take up to 30 days to process. Now Journey cannot assume responsibility for any additional costs or any fees relating to the issuance and/or cancellation of air tickets or other travel arrangements not made through Now Journey.
LUGGAGE HANDLING WHILE ON NOW JOURNEY TRIP
Now Journey is not responsible for lost or damaged luggage. Luggage is handled at the owner's risk throughout the trip. Wheeled carry on bags are counted as a full-size piece of luggage and may incur an additional portage charge if brought as a second bag.
LUGGAGE HANDLING BEFORE OR AFTER THE NOW JOURNEY TRIP
Now Journey is not responsible for luggage prior to traveler arrival at Now Journey hotel or after traveler departs Now Journey hotel.
If Now Journey is notified, prior to traveler(s) departure, Now Journey will advise traveler(s) of any relevant schedule changes to the itinerary. While Now Journey will endeavor to assist traveler(s) with any such changes, Now Journey is not liable for any additional expenses travelers may incur through a change in itinerary.
Now Journey regrets it is not in a position to render any assistance in the event the traveler is delayed at the outward or homeward points of departure. I AM RESPONSIBLE FOR ARRIVING ON TIME TO POINTS OF ORIGINATION BY Now Journey or its agents.
Now Journey provides on our branded small social group tours (not Personalized Journeys or concierge services) gratuities for the Local Guides, Drivers, and itinerary-included dining. Customary gratuities from $15 to $20 per person per day for the Journey Adventure Leader are not included in my tour package and should be extended on a voluntary, discretionary basis.
If I have any special requests, I will inform Now Journey as soon as possible in writing. Although Now Journey will endeavor to meet my requests, and I understand that Now Journey cannot guarantee to do so. Now Journey’s failure to accommodate my special requests will not be a breach of contract on the part of Now Journey. Now Journey cannot accept bookings that are conditional on the fulfillment of any special request; and such booking will be treated as a ‘normal’ booking (with no special requests.)
LIMITS ON NOW JOURNEY RESPONSIBILITY
I understand that Now Journey, its employees, officers, directors, adventure leaders, guides, staff and agents, do not own or operate any entity which is intended to or does provide goods or services for my travel event.
Now Journey purchases transportation (by aircraft, coach, train, vessel, or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers. All such persons and entities are independent contractors. As a result, Now Journey is not liable for any negligent or willful act of any such person or entity or of any third person. In addition and without limitation, Now Journey is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or Force Majeure, illness, disease, epidemic, pandemic, food poisoning, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, quarantines, criminal or terrorist activities of any kind, over booking or downgrading of services, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time. There are certain inherent risks in travel of the type involved with Now Journey. These include, but are not limited to, risks of river cruising, hiking, walking travel events, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. I understand that I assume all such risks with regard to these possibilities.
Any controversy or claim arising out of or relating to these Terms and Conditions, to the Limits on Now Journey’s responsibility clause, to the brochure, to any information relating in any way to the trip, to the trip itself, or to any products or services related to the trip, shall be settled solely and exclusively by binding arbitration in Denver, Colorado, in accordance with the Commercial Arbitration Rules of the American Arbitration Association, except that (a) in lieu of a personal appearance at arbitration, the arbitration may be conducted by telephonic means, (b) arbitration is the exclusive forum for dispute resolution (no court actions), and (c) except as otherwise provided by statute, each party shall bear its own costs and expenses and an equal share of the arbitrator and administrative fees.
I understand that arbitration against Now Journey must be commenced within one year following the date of travel event completion. Neither Now Journey nor any affiliate shall in any case be liable for other than compensatory damages, and I hereby waive any right to punitive damages.
PARTICIPATION & CONDUCT WHILE ON TOUR
Now Journey offers small social group travel events and Personalized Journeys and concierge services. I understand that when I participate, Now Journey will do its best to ensure that my trip is enjoyable for me and the entire group (if in a group tour). I am responsible for respecting the authority and following the directions of the Journey Adventure Leader and any designated representative of Now Journey, any guidelines expressed or implied from Now Journey tour communications, and the laws of the countries in the Itinerary during a tour. Now Journey may exclude me from participating in all or any part of the tour or remove me entirely from the Tour if, at the sole discretion of Journey Adventure Leader, my condition or behavior renders me unfit for the Tour or unfit for continuation once the Tour has begun. Unfitness may include, without limitation, any behavior that regardless of its cause, is inappropriate or offensive or interferes with the delivery of tour services or may constitute a hazard or embarrassment. Any decision(s)s to exclude or remove me or members of my party are at the complete discretion of the Journey Adventure Leader.
Should I decide for any reason not to participate in certain parts of the tour or trip or use certain goods included in the tour or trip, no refunds will be made for those unused parts or goods of the tour or trip.
In either case, Now Journey will not refund or cover any cost or expenses incurred for termination of vacation arrangements due to unacceptable conduct and will offer no assistance with onward travel.
I understand that I and any minors in my charge are required to provide a description of any disabilities or needs that would require special assistance. It is my responsibility to report those needs to Now Journey at the time the reservation is made. Now Journey will make reasonable attempts to accommodate the special needs of disabled travelers, but is not responsible in the event it is unable to do so, nor is Now Journey responsible for any denial of services by air carriers, hotels, restaurants, or other independent suppliers. Now Journey cannot provide assistance to a traveler for walking, dining, getting on and off transportation, or other personal needs. Now Journey requires that a qualified and physically able companion must accompany travelers who need such assistance. Now Journey is not responsible for any missed activities due to a participant’s inability to participate with the group.
Digital acknowledgement of Trip Agreement indicates agreement by Traveler(s).
